Poluição proveniente do derramamento de óleo por embarcações no meio ambiente marinho: análise a luz das legislação e das decisões proferidas pelos tribunais brasileiros

Abstract

Pollution from vesselsis one of the oldest forms of pollution in the marine environment. Traditionally, itwas caused by transport and routine activities resulting from operations that fora long time were considered habitual and normal, such as thedischarge of garbage from vessels, deteriorated goods, water from the tanks, etc. With the evolution of combustion engines overthe course of the 20th century, oil spills by vessels, mainly due to maritime accidents, started to stand out in the international scenario and, not long after, to Brazil. The factors that contributed to the awakening of thisenvironmental theme are diverse, being that the great accidents of the navigation served as the driving force for the legal protection with respect to the pollution coming from oil spillage by vessels. In this way, the present work has the objective of presenting the problem of pollution from oil spills by vessels in the marine environment, especially in the light of the recent decisions by the Brazilian courts and under the national and international legislation.
